Does RightScale need to sign a Business Associate Agreement (BAA)?

Background Information

A HIPAA business associate agreement (BAA) is a contract between a HIPAA covered entity and a HIPAA business associate (BA). The contract protects personal health information (PHI) in accordance with HIPAA guidelines. A BAA typically defines how a BA will report and respond to a data breaches, including ones that are caused by a business associate's subcontractors. 

 

 


Answer

Data, including HIPAA/PHI data, is neither stored, created, received, maintained, nor transmitted in the RightScale system. Since RightScale has historically never been considered a business associate or covered entity, we haven't had to sign a BA with our HIPPA-compliant customers.
